Welcome to DocVibe. These Terms of Use ("Terms") govern your access to and use of the DocVibe mobile application ("App"). Please read these Terms carefully before using the App. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using DocVibe, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the DocVibe app solely for your personal, non-commercial use on devices that you own or control.

3. Service Description

DocVibe is a mobile application that allows users to interact with PDF documents using artificial intelligence. The App provides features including but not limited to:

• Document upload and processing
• AI-powered question answering about documents
• Document text extraction and analysis
• Chat interface for document interaction
• Document management and organization

4. Anonymous Authentication and Device Tracking

• DocVibe uses an anonymous authentication system that automatically creates a user account when you first use the App - no email or password is required.
• To manage usage limits and prevent abuse, we generate a unique device fingerprint based on your device characteristics (such as device model, operating system, and hardware specifications).
• This device fingerprint is used to track daily usage limits across all users on the same device. Usage limits are shared among all accounts that use the same device.
• Your anonymous user session and device fingerprint are linked to manage subscriptions and feature access through RevenueCat.
• No personal information is required to use the App, but device fingerprinting enables us to provide fair usage limits and prevent abuse.

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not upload any malicious files or content that could harm the App or other users
• Not attempt to reverse engineer, decompile, or modify the App
• Not use the App to violate any third-party rights
• Not interfere with or disrupt the App's services or servers
• Not use the App to process documents containing illegal content
• Not attempt to circumvent usage limits or device fingerprinting systems
• Respect copyright and intellectual property rights of document owners

6. Content and Intellectual Property

6.1 Your Content

• You retain ownership of your documents and content uploaded to the App
• You grant us a limited license to process and analyze your content solely to provide the App's services
• You are responsible for ensuring you have the right to use and share any content you upload
• You warrant that your use of the App does not infringe on any third-party rights

6.2 Our Content

• The App, including its original content, features, and functionality, is owned by DocVibe and protected by intellectual property laws
• You may not copy, modify, distribute, or create derivative works based on our content without explicit permission
• All trademarks, service marks, and logos used in the App are the property of DocVibe or their respective owners

7. Usage Limits and Device Fingerprinting

• The App implements daily usage limits based on subscription tiers (free users: 5 messages/day, premium users: 75 messages/day)
• Usage limits are enforced per device fingerprint, meaning all accounts using the same device share the same daily limit pool
• Device fingerprinting is based on hardware characteristics and does not collect personal information
• Attempts to circumvent these limits may result in temporary or permanent blocking of your device fingerprint
• Usage counters reset daily at 00:05 UTC

8. Subscription and Payments

• The App offers both free and premium (Pro) features
• Premium features require payment through the Apple App Store or Google Play Store
• Subscription terms, pricing, and renewal policies are managed by the respective app stores
• Anonymous accounts are linked to subscriptions through RevenueCat using your device fingerprint and anonymous user ID
• Refunds are processed according to the app store policies and may involve sharing usage data as described in our Privacy Policy
• We reserve the right to modify pricing and subscription terms with reasonable notice

9. Third-Party Services

The App integrates with various third-party services including:

• OpenAI, Google Gemini, and Anthropic Claude (via OpenRouter API) for AI processing
• Supabase for backend services and anonymous authentication
• RevenueCat for subscription management
• Apple App Store and Google Play Store for payments
• Google Document AI for OCR and text extraction

Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or reliability of third-party services.

10. Data Processing and AI Services

• By using the App, you consent to the processing of your documents by AI services for the purpose of generating responses
• AI-generated responses are provided for informational purposes only and should not be considered professional advice
• You acknowledge that AI processing may not always be 100% accurate
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• Device fingerprints are used solely for usage tracking and abuse prevention

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The App will be error-free or uninterrupted
• Results from using the App will be accurate or reliable
• The quality of the App will meet your expectations
• Any defects in the App will be corrected
• AI-generated responses will be accurate or suitable for your specific needs
• Device fingerprinting will be 100% accurate in all cases

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCVIBE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or other intangible losses
• Any damages arising from your use of or inability to use the App
• Any damages resulting from AI-generated content or responses
• Any damages resulting from third-party service interruptions
• Any issues related to device fingerprinting or usage limit enforcement
• The total liability of DocVibe shall not exceed the amount you paid for the App in the past 12 months

13. Indemnification

You agree to indemnify and hold harmless DocVibe and its affiliates from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the App
• Your violation of any third-party rights
• Any content you upload or process through the App
• Your breach of any representation or warranty contained in these Terms
• Any attempts to circumvent usage limits or device fingerprinting systems

14. Prohibited Uses

You may not use the App for:

• Processing documents containing personal information of others without consent
• Generating content that violates applicable laws or regulations
• Attempting to extract or reverse engineer proprietary information
• Commercial use beyond your subscription limits
• Activities that could damage, disable, or impair the App's functionality
• Attempting to manipulate or bypass device fingerprinting systems
• Using multiple devices or methods to circumvent usage limits

15. Termination

• We may terminate or suspend your access to the App immediately for violations of these Terms
• You may terminate your use of the App at any time by uninstalling it
• Upon termination, relevant sections of these Terms will survive
• Termination may include blocking your device fingerprint from accessing the service
• We reserve the right to delete your data after account termination as outlined in our Privacy Policy

16. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last Updated" date
• Providing in-app notifications
• Continued use of the App after changes constitutes acceptance of the modified Terms

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DocVibe operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

18. Age Requirements

The App uses anonymous authentication and does not collect personal information during normal use. However, creating a subscription requires interaction with app store systems that may have their own age requirements. Users under 13 years of age should not use the App without parental/guardian supervision. By using the App, you affirm that you are either an adult or, if a minor, that you have obtained the necessary supervision to use the App.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocVibe regarding the use of the App and supersede all prior agreements and understandings.

By using DocVibe, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
